After selecting your property – Once you have chosen you ideal property the next step is to draw up a contract known as a Reservation Contract, between the buyer (you) and the vendor (owner/builder). A deposit of normally 5% of the selling price is held, this can vary slightly between each vendor. This then enables the property to be taken off the market until the contracts have been exchanged. At this stage you will need to open a bank account which we will assist you with.

At this point we advise that you employ a Lawyer, we are able to provide you with information on English speaking Lawyer’s. We can recommend an English speaking lawyer who we have an established relationship and have negotiated excellent rates. He will be able to handle everything from the initial contract to ensuring that all your utilities are connected.

After agreeing and signing of the reservation contract – The next step is to apply for Military Clearance. All Foreigners are subject to receiving clearance from the Ministry of Defense before any purchase of property in Turkey can be completed. This procedure checks the current deeds to the property to see if there are any charges registered against the property and that the property can be sold. This can take between 3-4 months, the Title Deed (Tapu) cannot be transferred into new ownership until clearance is received.

Off-Plan Property – Whilst we are waiting for the clearance to come through the construction continues and payments are made according to the initial contract.

Clearance Received – Once clearance has been received we can then transfer the title deed (Tapu) into the buyers name, to do this there are a number of things we need to do:

1- Obtain a Turkish Tax Number from the tax office.
2- Attend the Land Registry Office to transfer the title deed.
3- Register you as new owners of the property in the Municipality.
4- Arrange for all Utilities to be registered in your name.

The transfer of the Tapu for Off-plan properties will be transferred after completion of the construction but not before clearance is received.

Exchange of Contracts
This is the contract between the buyer and the vendor for the purchase of the property, which will state all the details concerning the property and parties involved. At this point a date is agreed to transfer the rest of the funds, this is usually done when the Tapu is transferred.

Costs
Agency Commission – Rate charged to the Buyer 3% of the purchase price.
Purchase Tax – 3% purchase price (Stamp Duty)
Property Tax – 0.1% of property value paid annually, new builds are exempt for 5 years.

There will be other cost relating to the transfer of the Deeds and also solicitors fees, but in total it should not amount to more than 10% of the purchase price.
